Although there is no such thing as a “standard agreement of sale”, the following contracts cover the very basics of what is needed to conclude a valid transaction in Namibia.

Sale of Land or Sectional Title Unit

The following two documents could be used as it covers the most important areas in order to conclude a valid real estate transaction in Namibia. Please note that these agreements are NOT suitable to use for the sale of member’s interest in a close corporation or the sale of shares in a company where the intention is for the property “to change hands” by means of the sale of the member’s interest or shares in the legal entity.

Sale of Member’s Interest in Close Corporation

The following agreements should be suitable to use in order to effect the sale of member’s interest in a close corporation where the intention is for the property (sectional title unit or residential erf) “to change hands” by means of the transfer of the member’s interest (and claims) in the close corporation.
