According to the government gazette released on 19 August 2011.  Windhoek residends are compelled to apply for a Building Compliance Certificate when selling their properties.

Such certificates are obtainable of N$ 500.00 from the building control section as the customer care section.

To ensure that all requirements of the compliance certificates are met, the following chkecklist is available to guide clients:

Due to the fact that a lot of discrepancies were discovered during compliance inspections and only a few Building Compliance Certificates were issued, the City of Windhoek implemented an interim measurement until 31st of December 2012.

Although the issuing will continue as regulated and Compliance Certificate still need to be issued before transfer can be registered, in the case of non compliance, an agreement could be signed between the seller and buyer, whereby it is agreed that compliance will be reached by the buyer within six months from date of agreement.

The initial non compliance will therefore not affect (delay) the transactions to be registered in the Deeds Registry.
